Abstract
State the EU doesn’t have competence to regulate relationships between state and church and religion state relationships are not governed by EU legislation and there is no European or member states model of those relationships. EU respects legal status of churches and religious communities under the member states laws, but the development of EU legislation, especially in the field of antidiscrimination, and the religion clauses in the EU regulations and directives have very important influence on state church law and are increasingly relevant for all member states. The result of that development in the field of antidiscrimination is the treaty provision according which the EU shall maintain an open, transparent and regular dialogue with churches and organizations whose identity recognizing under the national law. It can be expected that the results of the strengthening of the dialogue and cooperation between EU/member states and churches and religious communities will be the development of model of separation between church and state, which will be combined with co-operation and state aid.
