Abstract

Gender equality in the judiciary has been historically uneven and still varies considerably among countries, where women often remain underrepresented in high-ranking positions. Since its ‍2010–2012 evaluation cycle, the European Commission for Efficiency of Justice (CEPEJ) recognized the need for a better understanding of gender issues in the judiciary, tracking progress and changes in female representation in the judiciary. CEPEJ reports show that Serbia consistently boasts a figure of over 60% of female judges overall, including a comparatively high percentage of female court presidents. However, it remains questionable whether this track record can be attributable to clear policy and legislative measures fostering improved access of women to judicial careers. A closer look at the regulatory framework on the status, appointment and promotion of judges in Serbia shows that there are no sector-specific rules aimed at furthering such an approach. The paper provides a systemic overview of position of women in the Serbian judiciary from a legal perspective. This is done through a qualitative and quantitative analysis of data on the percentage of women judges at courts of all instances, including specialized courts, female court presidents and the High Judicial Council. The paper also sheds lights on tendencies in judicial appointments and promotions in recent years. Employing normative, comparative and exegetic methods, the authors analyse the current relevant regulatory framework in Serbia, identify and pinpoint indirect disincentives for women, assessing the state of play in Serbia against neighbouring countries and global trends.
