Abstract
In this paper the author analyses the theoretical and legal legitimacy of constitutional review of constitutional amendments in the Republic of Serbia in the context of three variables - the authority of the Constitutional Court of Serbia to review constitutional amendments, the existence of unamendable provisions in the Serbian Constitution and the constitutional amendment procedure. The conclusion is that the constitutional review of constitutional amendments in Republic of Serbia would have its legal legitimacy, and in some cases would be necessary as the last defense of the (Rechts)staat.
