Abstract
The growing use of artificial intelligence (AI) by lawyers is transforming the delivery of legal services. AI can improve efficiency, reduce costs, and enable lawyers to process large volumes of information more rapidly. However, the integration of AI also raises significant legal and professional issues, as AI systems may generate inaccurate or fabricated information, potentially giving rise to claims of professional negligence and liability. This paper examines whether damage arising from the use of AI falls within the scope of professional indemnity insurance, given that AI-related risks are not yet explicitly excluded, despite the lack of information necessary for adequate risk assessment. The author argues that coverage may depend on whether the lawyer’s conduct qualifies as a covered ‘professional service’ and whether the technology was reasonably supervised. Consequently, insurers are likely to place greater emphasis on lawyers’ AI governance, verification procedures, data protection, and technological competence when underwriting professional liability risks, drawing on comparative legal solutions.
