Abstract
The executive function in the current parliamentary systems is being implemented through the bicefal executive, i.e. by the head of the state and government. The relation between these two bodies of executive authority varies considerably from state to state, weather in favor of one or another one. Besides constitutional determinations, the position of the president of the republic is under the strong influence of the personal authority and the reputation of the person who acts as the head of the state, and then, as well, of the structure of the political parties’ relations in the country. Comparative – legal review of the presidential institution in France, Serbia and Germany presents the variety of constitutional and legal solutions for the position, role, election, jurisdiction and powers, but also responsibilities of the president of the republic as the head of the state and a part of bicelfal executive and his relationship with other bodies in the organization of the state authority.
