Abstract

The paper discusses the protection of indications of geographical origin in Serbia. After the introductory notes on the role of indications of geographical origin in the economy in general, the first part of the paper is dedicated to the legal bases for the protection of geographical indications on the international and EU level. The special attention is paid to the Council Regulation (EC) 510/2006 on the protection of geographical indications and designations of the origin for agricultural products and foodstuffs. The protection of indications of geographical origin in the Serbian legislation is presented in the second part of the paper. In 2010, Serbia adopted the Law on Indications of Geographical Origin, which is harmonised with the Regulation 510/2006 to a considerable extent. In 2011, the Serbian Government passed the Strategy of Intellectual Property Development for a period 2011 to 2015. In its Opinion on Serbia’s application for membership, the Commission stated that although Serbia had legislation in place regulating protection of designation of origin, geographical indications and traditional names, this legislation had to be amended and updated to be brought fully in line with the EU acquis. Therefore, in the third part of the paper, the author analyses the degree of harmonisation of the Law on Indications of Geographical Origin with the Council Regulation 510/2006 on the protection of geographical indications and designations of the origin for agricultural products and foodstuffs. Bearing in mind that only the system of protection of indications of geographical origin in the European Union secures the competitiveness of the domestic products on the European market, the author concludes that it is necessary to introduce amendments to the Law on Indications of Geographical Origin to ensure its full harmonisation with the Council Regulation 510/2006.
