Abstract

This analysis is aimed at supporting the ongoing efforts made towards advancing the existing anti-corruption law. In doing so, it will assess the compliance of the selected issues of the applicable Montenegrin Law on Corruption Prevention with relevant international standards. The issue of institutional independence will remain out of this analysis since there were already donor-funded activities performed in assessing its institutional independence and its related capacities. Various international standards mandate that adequate legal grounds need to be in place as a basis for the successful operation of the national anti-corruption body. This analysis will be limited to the assessment of the alignment of the current anti-corruption legal framework and practices with the applicable international standards pertaining to the following corruption risk areas: 1.Regime governing declarations submitted by different categories of persons 2. Regime governing gifts and other kinds of material privileges 3.Regime governing post-employment restrictions 4.Regime governing ad hoc identification and reporting of situations that may result in conflict of interest The analysis is structured in accordance with the aforementioned selected corruption risk areas.
