Abstract

The authors analyzed Serbian legislation in regards to misdemeanor criminal offences and felonies related to the prevention of reckless and dangerous driving (aggressive driving). Using examples from foreign legislature (Germany, Holland, and Spain) and from those in Serbian practice, it can be seen that the traditional approach to the distinction between misdemeanors and felonies must be altered. The particularly dangerous nature of driving, the great danger of serious consequences and their predictability and prevention from the point of view of an averagely reasonable person is the reason why it is proposed that, similar to the German legal solution, such behavior is to be considered a felony with the possibility of harmful consequences.
