Abstract

It is the goal of this article to highlight the relation between the hierarchy of the legal order and the constitutional review of by laws and other general acts. The constitutional review of by laws and other general acts is faced with many theoretical and practical issues such are: what is the basis for constitutional review of such acts, is the general act which is not in compliance with law also unconstitutional due the hierarchy of legal order provided by the constitution and, if it is, does it mean that the general act which is not in accordance with other general act of higher level also isn’t in accordance with the law, is it possible for constitutional court to review the compliance between general acts, etc. Those issues can be under the influence of the horizontal and vertical separation of powers and are regulated differently in comparative law and constitutional praxis.
